4. PRODUCT CONFORMANCE PROVISIONS
4.1 Product Conformance. The products provided shall meet the salient characteristics of this
commercial item description, conform to the producer's own drawings, specifications, standards,
and quality assurance practices and be the same product offered for sale in the commercial
market. The Government reserves the right to require proof of such conformance.
4.2 Market Acceptability.
4.2.1 Documentation. Literature describing the safety guard, performance characteristics and
testing data or calculations showing that it meets the safety pressure requirements of this CID.
a. Literature describing the safety guard and performance characteristics (catalogs,
brochures, specification sheets).
b. Set of drawings for the unit. This shall include drawings for major components.
Documentation showing that the same unit has been sold to the government. If substantially
identical production units have been sold to the government, evidence to allow the government
to substantiate the safe, reliable performance and satisfactory quality of the production units must
be submitted with the offeror's request for waiver of bid samples. This evidence shall include
contract numbers, quantities sold, location of the procuring activity and names and telephone
numbers of the contracting officer. The government reserves the right to make a determination
as to whether this condition has been met, by making use of any evidence submitted by the
offeror as well as evidence available within official government records. The units must have a
proven record of performance showing that they are safe, reliable and satisfactory in
performance, materials and quality of construction.
c. Documentation showing that the same unit has been sold commercially. Substantially
identical production units have been sold to commercial customers in sufficient quantities so as
to demonstrate the reliability of the units in their application, performance, safety and acceptance
of the units by the commercial market through continued procurement and usage.
d. Failure to submit adequate documentation to substantiate items subparagraphs (a) through
(d) above will be cause for bid sample submittal.
4.3 Production units. All production units delivered under this contract shall have the same
parts, part numbers, configuration, materials, and process as those of the approved bid sample.
In addition, production units shall be fabricated from the same parts and part numbers (original
manufacturer's part numbers) being that those components and part numbers were utilized on the
approved bid sample. No substitute part numbers will be allowed.
5. PACKAGING.
5.1 Preservation, Packaging, Packing, Labeling and Markings. Preservation, packaging,
labeling, and marking shall be specified in the contract or order.
